Service Agreement
This Service agreement is a back to back agreement with reference to the information
within the respective WhatsApp messages that takes effect as per clause 6 below.
This Service Agreement ("Agreement") is entered into on [Date],
between [Driver's Name] [Driver's Address], and [Client's Name] [Client's Address].
1. Services Provided
The Driver agrees to provide transportation services to the Client as requested through [App/Service/Manual Booking]. These services will include picking up the Client from a designated location and transporting the Client to a predetermined destination as specified in each booking request.
2. Compensation
Client agrees to compensate the Driver for the transportation services at rates agreed upon at the time of each booking. Payment is due upon completion of the service unless otherwise agreed.
3. Terms of Service
The Driver will make every effort to transport the Client to their destination safely and in a timely manner, adhering to all applicable traffic laws.
4. Limitation of Liability for Uncontrollable Events
The Driver shall not be held responsible or liable for any delay or failure in performance resulting from causes beyond their reasonable control, including but not limited to traffic congestion, road accidents, severe weather conditions, or any other circumstances considered as force majeure. In the event of such delays, the Driver agrees to notify the Client at the earliest possible opportunity with updated Estimated Time of Arrival (ETA) using real-time data available via GPS or other reliable systems. The Client acknowledges that these ETAs are estimates and subject to change due to factors outside the Driver’s control. The Client agrees that the Driver shall not be liable for any losses, damages, or penalties resulting from delays caused by such uncontrollable events.
5. Cancellation Policy
Both the Driver and the Client may cancel the service request; however, the Client must cancel at least [X hours] prior to the scheduled pickup time. If the Client cancels later than this period, a cancellation fee may apply.
6. Acceptance of Agreement
This Agreement becomes effective immediately upon the Client’s receipt of a confirmation message from the Driver via WhatsApp, acknowledging the terms herein. No physical signatures are required; the digital acknowledgment of this Agreement via WhatsApp constitutes a binding acceptance by both parties.
7. Amendments
This Agreement may only be amended in writing and agreed upon by both parties, either digitally or in hard copy.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state/country in which the services are provided.
9. Confirmation
Both parties agree to the terms and conditions set forth in this Agreement and will confirm agreement through WhatsApp communication:
